This agreement is a legal document which sets out your rights and obligations, and those of Echoes Gallery, in relation to the services offered by us through echoesgallery.co.uk.
Effect of this agreement
Viewing of the echoesgallery.co.uk site itself is free; but when you register for the site, you agree to the terms of this agreement, and you re-affirm that agreement every time you use the echoesgallery.co.uk services, so we recommend you read this agreement so you know what you're getting yourself into.
Applicable law
Echoes Gallery is a company registered in England, and every sale shall be deemed to be performed in England; English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.
Making a contract with us
In return for the service we will provide for you, we ask that you agree to register for echoesgallery.co.uk using your correct name, address and any other requested details. You may be asked to enter credit, debit or charge card details. Misuse of our site
Echoesgallery.co.uk reserves the right to suspend or terminate any members account which, is, or appears to us in our absolute discretion, to be, in breach of any of the provisions of this agreement.
When will you be charged?
As soon as your order is processed.
Tax & Duties
We will charge VAT on all goods (artworks) and services where applicable. And if you want your purchase to be delivered outside the European Union, you will automatically be responsible for paying all applicable duties Shipping & Returns.
Corrections
Descriptions of goods (artworks) and services included in the echoesgallery.com are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should know that the colours and appearance of images, mounts and frames may vary very slightly from the way they appear on the screen. Copyright
The images and designs used on the echoesgallery.co.uk are the property of Echoes Gallery Ltd. or their respective copyright owners, and are used by echoesgallery.co.uk pursuant to express authorisation from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to echoesgallery.co.uk are vested in Echoes Gallery or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An interim injunction is a court order, which would prevent any further use or distribution of the image concerned, until a final court hearing where the court will make a decision based on all the facts.
Loss
Please be aware that we will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused. You also agree that the liability of Echoes Gallery under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you.
This does not affect your statutory rights as a consumer.
Reasonable Control
Echoes Gallery Ltd shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. Matters deemed beyond echoesgallery.co.uk control include
Riots and other forms of civil commotion
Floods, fires and other natural disasters
Local legislation and regulations
Acts of God and or Aliens
Matters of regional or national crisis - e.g. blockade, war etc.
Changes to this Agreement
Echoes Gallery reserves the right to change the terms of this agreement when it is deemed necessary, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.
Severability
In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.
Passwords
To use certain features of the Service, you will need a username and password, which you will receive through the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are responsible for all activities that occur under your password or account. You agree to notify echoesgallery.co.uk immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. Echoesgallery.co.uk cannot and will not be liable for any loss or damage arising from your failure to protect your password or account information. You may not disclose or share your password to any third parties or use your password for any unauthorised purpose.
